DSHS/DCYF removed M.D., a then perfectly healthy 18-month-old, from a stable foster care placement in Washington and placed her into the home of her alleged father in Texas. Two months later he severely beat her. As a result, M.D. suffered severe brain damage, rendering her quadriplegic, blind, and unable to feed or care for herself in any manner for the rest of her life.
Prior to placing M.D. in Texas, DSHS/DCYF failed to read a 26-page home study that had been completed by the State of Texas, contrary to DSHS/DCYF policies. This home study raised numerous red flags regarding the safety of the placement. In addition, DSHS/DCYF failed to review their own files, which also contained concerning information of the alleged father.
Ressler & Tesh obtained a settlement of $19,300,000 for M.D. This settlement will take care of M.D. for the rest of her life. In addition, it is the largest single plaintiff settlement against DSHS/DCYF.

The Plaintiffs were a couple injured in a head-on collision with a large commercial truck. The settlements were obtained from the operators of two trucks, one of which was attempting to make an illegal pass and the other of which failed to allow the passing truck to return to the proper lane. This case involves the tragic death of three-year-old Hazel Homan, who was murdered by her caregiver Kamee Dixon. At the time of her death, Hazel was a dependent child. Serious concerns had been raised within DSHS/DYCF about Ms. Dixon’s background and whether she was an appropriate person to be caring for Hazel. Moreover, numerous CPS referrals were made regarding unexplained injuries Hazel had suffered in the months leading up to her death, including a serious burn to her hand and an eye injury caused by unknown chemicals. Despite all these concerns, Hazel remained in the custody of Ms. Dixon who continued to abuse her, culminating in the infliction of fatal injuries on November 27, 2019. This combined settlement was reached with the State of Washington and a daycare provider that Hazel attended in the months before her death. Ressler & Tesh obtained a settlement of $18,500,000 for Hazel’s estate.

Kennan-Justice Kobe Ford died at age four from massive brain injuries inflicted by his mother and her boyfriend. From 2020 until Kennan-Justice’s death in 2022, DSHS/DCYF received three referrals of abuse and neglect perpetrated against Kennan-Justice by his mother and her boyfriends. The final of these referrals included allegations of unexplained injuries to Kennan-Justice and domestic violence in the home. This referral was never investigated by DSHS/DCYF and Kennan-Justice died later that year. No disciplinary action was taken with respect to any of the workers who handled the final referral. Kennan-Justice’s mother and her boyfriend are currently awaiting trial for Murder in the Second Degree in King County. Ressler & Tesh obtained a settlement of $15,000,000 for Kennan-Justice’s estate.

Jose Fernandez Armas died at age two from massive internal injuries inflicted by his mother. DSHS/DCYF received a child abuse referral just three months before Jose’s death, detailing that he was being severely abused in a small motel room shared by his mother and her boyfriend. During the litigation, numerous DSHS/DCYF employees admitted that the investigation into this CPS referral was incomplete. Had the investigation been properly investigated, Jose would have been removed from the abusive home he was living in and would be alive today. No disciplinary action was taken with respect to any of the workers who handled the referral. Ressler & Tesh obtained a settlement of $17,000,000 for Jose’s estate.

Plaintiffs were three young girls placed with foster parents who were grossly unfit to care for them. Despite numerous red flags known to DSHS/DCYF, the girls remained in their care where they suffered unthinkable sexual abuse and torture at the hands of their foster father. The girls are now in stable placements getting the treatment they need, and the foster father is serving a lengthy prison sentence. Ressler & Tesh obtained a settlement of $9,900,000 for the Plaintiffs.

Aaryuss Martis Weston died at age five from an acute brain bleed allegedly inflicted by his mother’s boyfriend. In the final weeks and months of his life, he sustained numerous injuries before his grandmother brought him to Harborview Medical Center for treatment of extreme head pain. After it was explained to Harborview employees that Aaryuss was a likely victim of child abuse, Aaryuss was nonetheless turned away for treatment. One of these employees was a man who had previously received several complaints by coworkers and staff regarding racist comments made by him and inappropriate behaviors toward staff and patients. Aaryuss and his grandmother were both African American. This employee was terminated from his position due to his failure to admit Aaryuss for treatment. Five days after being turned away at Harborview, Aaryuss died from his injuries. Prior to his death, DSHS/DCYF received numerous reports of abuse and neglect pertaining to Aaryuss and his siblings. Regarding Aaryuss specifically, DSHS/DCYF received four reports of suspected child abuse and neglect and either conducted investigations contrary to policy or failed to act at all. Ressler & Tesh obtained a settlement of $9,500,000 against both Harborview Medical Center and DSHS/DCYF for Aaryuss’ estate.

Timothy Jones was placed in the home of Price Nick Miller Jr., a family friend, after his mother lost her home to foreclosure. One month later, DSHS/DCYF was notified that Miller was paying excessive attention toward children who were not his own, including Timothy. Timothy was removed from Miller’s home, but Miller continued to stalk Timothy at school, counseling appointments, and subsequent foster placements. One DSHS/DCYF social worker suggested letting the relationship “run its course.” Despite the numerous concerns of sexual abuse raised to DSHS/DCYF, the contact between Timothy and Miller continued, unabated for years. In 2006, Timothy disclosed that Miller had sexually, physically, and emotionally abused him for nearly a decade. Timothy died by suicide in 2018. Ressler & Tesh obtained a settlement of $8,800,000 for Timothy’s estate. Timothy’s lawsuit is a landmark case for childhood sexual abuse survivors in the State of Washington. Tyler DeLeon died of starvation on his seventh birthday. At the time of his death, his bruised and battered body weighed just 28 pounds having been systematically starved and abused by his foster mother, Carole DeLeon.
Inexcusably, Tyler DeLeon was one of many children placed in the DeLeon home despite the fact that Ms. Delone had previously lost her foster care license when DSHS/DCYF determined that she had abused and starved foster children in her home.
In addition, some of the surviving Plaintiffs alleged that their doctors failed to report obvious signs of neglect, abuse, and starvation.
This case resulted in an appeal heard by the Washington State Supreme Court, the result of which clarified the law allowing health care providers to be sued solely for their failure to report suspected signs of abuse under RCW 26.44 as distinguished from medical malpractice actions. Beggs v. DSHS 171 Wn.2d 69.
In 2012, DSHS/DCYF settled their portion of the case for $6,100,000.
